TERMS AND CONDITIONS (T&Cs)
These General Terms and Conditions of Sale (T&Cs) are entered into by and between :
Maison Aryana
Hereinafter referred to as ‘the Seller’,
And any individual or legal entity wishing to make a purchase on the maison-aryana.com website
Hereinafter referred to as ‘the Customer’.
1. Purpose
The purpose of these General Terms and Conditions is to define the terms and conditions of sale of the products offered by the Seller on its website. They apply to all orders placed by the Customer on the site, whether for personalised jewellery or other items offered.
By validating his/her order, the Customer unreservedly accepts these T&Cs.
2. Products
The products offered for sale are those described and presented on the site. The Vendor endeavours to provide descriptions that are as accurate as possible. However, the photos of the products are provided for information only and may vary slightly from the items received, particularly for personalised jewellery, which is handmade.
3. Prices
Prices are indicated in euros (€), inclusive of all taxes (VAT), and are those in force at the time the order is validated by the Customer. Delivery costs are not included in the price of the products and will be specified before the final validation of the order.
The Vendor reserves the right to modify its prices at any time. However, products will be invoiced at the price displayed when the order is validated.
4. Order
The order is validated once the Customer has accepted these T&Cs, selected his/her products and made payment. A confirmation email summarising the order will be sent to the Customer at the email address provided.
The Vendor reserves the right to cancel or refuse an order in the event of a dispute with the Customer or for any other legitimate reason, in particular in the event of non-payment or suspected fraud.
5. Payment
Orders are paid for using the payment methods available on the site (bank card, PayPal, etc.). The Vendor uses secure payment solutions, and no Customer banking information is stored by the Vendor.
Payment must be made in full at the time the order is placed. In the event of non-payment, the order cannot be validated or dispatched.
6. Delivery
Products are delivered to the address indicated by the Customer at the time of ordering. Delivery times are given as an indication (between 10 and 14 days for Metropolitan France) and may vary according to the options chosen (standard, express, etc.) and the destination. For international deliveries, allow between 10 and 21 days for delivery, depending on the destination country. Customs duties are payable by the Customer.

For made-to-measure jewellery, additional manufacturing time may be required. The Seller will inform the Customer of the specific lead times when the order is placed.

In the event of a delay in delivery not attributable to the Seller (incorrect address, absence of the Customer at the time of delivery, etc.), no claim or compensation may be requested.

In the event of late delivery for which the Seller is not responsible (incorrect address, absence of the Customer at the time of delivery, etc.), no complaint or compensation may be claimed.

IMPORTANT: If La Poste's tracking system indicates that the parcel has been ‘delivered’ but that you have not received it, the Seller cannot be held responsible. You must contact La Poste's customer service department on 3631 in order to open an investigation.

The Customer must inform the Carrier (La Poste or other) and the Seller of any reservations regarding the product delivered, particularly if the package is damaged or open, as soon as it is received.
In the event of an open or damaged parcel, the Customer must have a ‘Report of Spoliation’ (form 170) drawn up by the postman or at the post office, so that the Seller can launch an investigation and compensation procedure.
The Customer has 48 hours in which to send the Vendor a copy of the Report of Spoliation by e-mail, together with a description of the damage found. Any claim received after this deadline will be considered null and void.
7. Right of withdrawal
In accordance with Article L221-18 of the French Consumer Code, the Customer has a period of 14 days from receipt of the order to exercise the right of withdrawal, without having to give any reason or pay any penalties.
However, by virtue of article L221-28 of the same Code, this right of withdrawal does not apply to personalised goods, such as jewellery made to the Customer's specifications.
For other non-personalised products, the Customer must return the items in their original condition, unworn and in their original packaging. The cost of returning the goods is borne by the Customer. Reimbursement will be made within 14 days of receipt of the returned items.
8. Conformity and guarantees
The Seller undertakes to supply products that comply with the descriptions given on the site and with the requirements of current French legislation.
In the event of a lack of conformity or hidden defect, the Customer is entitled to the legal guarantees provided by articles L217-4 et seq. of the French Consumer Code and 1641 et seq. of the French Civil Code. In the event of a defective product, the Customer may request a replacement subject to compliance with the legal conditions and within 14 days, by sending photos to the e-mail address available in the Contact tab.
9. Liability
The Seller may not be held liable for any damage resulting from improper use of the products purchased on the site.
Furthermore, the Vendor may not be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular in the event of a break in service, external intrusion or the presence of computer viruses.
10. Intellectual property rights
All elements of the site (texts, images, designs, logos, etc.) are protected by copyright and intellectual property. Any total or partial reproduction is strictly prohibited without the prior written authorisation of the Seller.
11. Protection of personal data
The Seller undertakes to protect the Customer's personal data in accordance with current legislation, in particular the General Data Protection Regulation (RGPD). For further information, the Customer is invited to consult the [Privacy Policy].
12. Disputes
These T&Cs are governed by French law. In the event of a dispute, the Customer is invited to contact customer services to attempt to resolve the dispute amicably. Failing agreement, the dispute will be referred to the competent courts in accordance with French law.
The Customer may also have recourse to mediation in accordance with article L611-1 of the French Consumer Code.
